These Terms of Service (“Terms”) govern your access to and use of the InstaGiveawayPicker website and services located at instagiveawaypicker.com (“Service”), operated by InstaGiveawayPicker (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By using InstaGiveawayPicker, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you do not agree with any part of these Terms, you must not use the Service.

2. Description of Service

InstaGiveawayPicker is a web-based tool that allows users to fetch publicly available comments from Instagram posts, reels, and carousels, apply filters, and randomly select a winner using a cryptographic random number generator. The Service is offered in both free and paid tiers.

3. Free and Paid Plans

The free tier allows limited comment fetching (up to 300 comments per post) and a limited number of giveaway draws per day. Paid plans (“Pro”) unlock additional features including unlimited comment fetching and unlimited draws. Details of available plans and pricing are listed on our Pricing page.

4. Payments and Billing

• All payments are processed securely through our authorized payment processor. We do not store your payment card details.
• Prices are listed in USD and include applicable taxes where required by law.
• Subscription plans (monthly/annual) automatically renew at the end of each billing period unless cancelled before the renewal date.
• One-time packs (e.g. 12 Giveaways) do not auto-renew and are valid for one year from the date of purchase.

5. Cancellation

You may cancel a subscription plan at any time. Upon cancellation, your Pro access will remain active until the end of your current billing period. No partial refunds are issued for unused portions of a billing period, except as described in our Refund Policy.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to reverse engineer, decompile, or disassemble any part of the Service.
• Use automated scripts, bots, or other means to access the Service in a manner that exceeds reasonable usage.
• Scrape, harvest, or collect data from the Service for resale or redistribution.
• Interfere with or disrupt the integrity or performance of the Service.

7. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, and software — are the exclusive property of InstaGiveawayPicker and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

8. Third-Party Services

The Service interacts with Instagram's publicly available data. InstaGiveawayPicker is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. or Instagram. We are not responsible for changes to Instagram's platform, API, or data availability that may affect the Service.

9. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that all comments from a post will be retrievable.

10. Limitation of Liability

To the maximum extent permitted by law, InstaGiveawayPicker shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
